If the Contract is subject to a satisfactory Building and Pest Inspection Reports you must take all reasonable steps to obtain the reports.
We recommend that you immediately arrange for Building and Pest Inspection reports immediately after signing the Contract.
If, acting reasonably, you are dissatisfied with the result of the Building Inspection Report then you may terminate the Contract by giving written notice to the Seller or their solicitors before 5:00pm on the inspection date. Otherwise the condition will be treated as being satisfied.
You may only terminate the Contract based on the result of the Pest Inspection Report if active termites or other pests are found in the main dwelling or building. The finding of active termites or other pests on other parts of the property will not give you grounds to terminate, nor will evidence of previous termite activity.
If you do terminate the Contract based on the Pest Inspection Report, you do so by giving written notice to the Seller or their solicitors before 5:00pm on the inspection date. Otherwise the condition will be treated as being satisfied.
When advising us of your satisfaction or otherwise of this condition you should notify us in enough time so we are able to prepare the requisite notice under the contract in time to protect your interests.
